Please read these Terms and Conditions ("Terms") before using the Library Near Me mobile app, web dashboard, or APIs. By creating an account or using the service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
1. The service
Library Near Me is a software-as-a-service platform for private libraries, reading rooms, and study spaces. It lets an authorized library account:
- Manage floors, seats, shifts, and seat allocation
- Admit students and maintain their profiles and documents
- Create fee packages, collect payments, and issue receipts
- Track attendance using QR codes
- Record expenses, staff salaries, tasks, enquiries, and visitors
- View collection and occupancy reports
- Send in-app notifications and announcements
Available features depend on your subscription plan and on the feature flags enabled for your library. We may add, change, or discontinue features.
2. Eligibility and accounts
To use Library Near Me you must:
- Be at least 18 years old and able to enter a binding contract
- Register with accurate library and contact details
- Keep your password confidential and not share your login
- Be authorized to act for the library you register
You are responsible for everything done under your account. Tell us immediately if you suspect unauthorized access.
2.1 Roles
A library workspace has an owner and may have staff accounts with limited access. Owners are responsible for who they invite and for what those accounts do. Platform administrator accounts are managed by us and cannot be deleted from the app.
3. Your responsibilities for student data
Your library decides what information to record about its students, so you are the controller of that data and we process it on your instructions. You agree that:
- You have a lawful basis to collect and store each student's details, documents, and photographs
- You will tell your students how their data is used and honour their requests to access or correct it
- You will only collect identity or address proof where you are permitted to do so
- You will not upload unlawful, infringing, or malicious content
- You will keep records accurate and delete what you no longer need
You will indemnify us for claims arising from data you or your staff enter into the platform.
4. Fees, payments, and receipts
4.1 Money you collect from students
Library Near Me records fee collection and generates receipts. We are not a payment processor and we do not hold, transfer, or settle your money. Cash, UPI, bank transfers, and any other payments are made directly between you and your student using the collection details you configure. You are responsible for the accuracy of your UPI ID, bank details, and any QR code you upload, and for issuing legally compliant receipts and invoices.
4.2 Subscription fees payable to us
Access to paid plans requires payment of the applicable subscription fee. Unless stated otherwise, fees are exclusive of taxes and are non-refundable for periods already used. We may change plan pricing with reasonable notice; changes apply from your next billing period.
4.3 Taxes
You are responsible for the taxes applicable to your library's operations, including GST where relevant.
5. Acceptable use
You agree not to:
- Use the service unlawfully or in breach of anyone's rights
- Upload data you have no right to hold, or harvest contact details
- Attempt to access another library's workspace, records, or documents
- Probe, scan, or overload our systems, or bypass rate limits and access controls
- Reverse engineer, resell, or sublicense the service without our written permission
- Use automated means to abuse authentication, notification, or reporting features
- Upload malware or content that damages the service or its users
We may investigate suspected abuse and cooperate with law enforcement where required.
6. Availability and support
We aim to keep the service available but do not guarantee uninterrupted operation. Maintenance, updates, third-party outages, and events beyond our control may cause downtime. We may suspend access temporarily to protect the security or integrity of the platform.
7. Suspension and termination
7.1 By you
You may stop using the service at any time and delete your account from the mobile app or the web dashboard by confirming with DELETE and your password. See our Privacy Policy for what happens to your data, and https://librarynear.me/delete-account for step-by-step instructions.
7.2 By us
We may suspend or terminate your access, with or without notice, if we reasonably believe you have:
- Breached these Terms or applicable law
- Failed to pay subscription fees when due
- Put the security, integrity, or lawful operation of the platform at risk
- Misused another person's data
Where a library is suspended, staff sign-in is blocked while records are preserved for the period required by law.
7.3 Effect of deletion
Deleting the last owner account of a library deactivates that library workspace. Financial and audit records are retained as described in the Privacy Policy.
8. Data export
While your account is active you may export your library data using the export features available in your plan. Please export anything you need before deleting your account, because deletion revokes your access immediately.
9. Intellectual property
The service, including its software, design, and documentation, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use it for your library's internal business purposes while your account is in good standing. Your library's own data remains yours.
10. Third-party services
The service relies on third parties such as hosting, email, and messaging providers, and may reference payment apps used by your students. We are not responsible for third-party services, their availability, or their terms.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Reports, receipts, and attendance data are generated from what you enter and do not constitute accounting, tax, or legal advice.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST OR CORRUPTED DATA.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE SUBSCRIPTION FEES YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR INR 1,000 IF YOU HAVE PAID NOTHING.
Some jurisdictions do not permit certain limitations; in those cases our liability is limited to the fullest extent the law allows.
13. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, and reasonable legal costs arising from your use of the service, the data you enter, your dealings with your students or staff, or your breach of these Terms or of applicable law.
14. Governing law and disputes
These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction, subject to any consumer protection rights available to you where you live. Please contact us first so we can try to resolve the matter informally.
15. Changes to these Terms
We may update these Terms. The "Last updated" date will change, and material updates may be announced in the app or by email. Continued use after an update means you accept the revised Terms. If you do not accept them, stop using the service and delete your account.
16. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy and any plan or order details, form the entire agreement between us regarding the service.
